By voluntarily providing us with Personal Information, you are consenting to our use of it in accordance with this Privacy Policy. Project Success Academy, LLC reserves the right to modify or amend this Privacy Policy at any time and for any reason. Please review this Privacy Policy periodically and particularly before you provide any Personal Information. Any changes to this Privacy Policy will become effective immediately when posted online at the Site. Your continued use of the Site after any modifications or amendments to the Privacy Policy shall indicate your agreement with the terms of the modified or amended Privacy Policy.  

A. PSA POLICY

Welcome to the Project Success Academy, LLC website (the “Site”). Project Success Academy, LLC is referred to in this Privacy Policy as “PSA”, “we,” “us,” or “our”. This Privacy Policy gives information to users of the Site or PSA services (“you” or “your”) about PSA practices with respect to information relating to or that could reasonably be associated with an individual (“Personal Information”). Please read this Privacy Policy carefully. IF YOU DO NOT AGREE WITH THE TERMS OF THIS PRIVACY POLICY, PLEASE DO NOT ACCESS THE SITE OR PSA SERVICES.

We provide professional development and educational services intended to help organizations with project success navigation and achieve clarity regarding project success, potential project roadblocks and to minimize risks of costly errors in project performance. Services are available only in the United States and are not intended to be available to individuals outside the United States or in a personal capacity.  

B. PERSONAL INFORMATION COLLECTED

When you interact with PSA through the Site or use of PSA services, we may collect and use certain Personal Information, described below.

1. Information You Provide Voluntarily
Website Visitors
We collect information you decide to share with us through use of the Site. If you use certain aspects of the Site, such as filling out a form or request for us to contact you, we may ask you to provide us with information about yourself such as your name, business email, job title, company name and/or business phone number. The same information may be requested because of your relationship as an employee or contractor of our customer or a prospective customer. It is possible that information provided by you may be Personal Information.

2. Information Collected Automatically
a. Do Not Track Requests
Some web browsers have a “Do Not Track” feature. This feature lets you tell websites you visit that you do not want to have your online activity tracked. These features are not yet uniform across browsers. You are able in Settings to opt out of tracking of your online activity.

b. CookiesCookies are pieces of data stored on your device that perform numerous functions. We and our service providers use cookies to help us understand how you navigate through the Site and to provide a more personalized and convenient experience. When you visit the Site, we and third parties that provide Site functionality and analysis regarding Site usage may receive, collect and store certain types of information through automatic data collection tools including cookies. The following type of cookies are used when you visit the Site unless you opt out in the Setting preferences:

C. USE OF PERSONAL INFORMATION

PSA does not sell or rent Personal Information to third parties, but your Personal Information may be used or shared in the following situations without further notice:

1. Perform Services
Personal Information may be used to fulfill requests regarding delivery of PSA services. We may also share Personal Information with contractors, agents, service providers who assist us in performing services and analyzing and improving the Site and PSA services. Use of Personal Information is based on one or more of the following: (1) you have given consent for one or more specific purposes; (2) as necessary to perform contractual obligations to our customers or to an authorized individual under any terms of use regarding visiting the Site or use of PSA services; (3) as necessary to comply with our legal obligations; and (4) as necessary for the purposes of our legitimate interests or the legitimate interests of a third party. Please note, with respect to subsection (2) above, this Privacy Policy is not a contract between us and you.

2. Business Changes 
Personal Information may be shared in connection with a merger, acquisition, financing, reorganization, receivership, or the sale or transfer of all or a portion of our assets or similar arrangement. If so, your Personal Information will be shared with parties involved in the arrangement or transaction and may be transferred to a successor or affiliate organization as a result. 

3. Promotional Communication 
When you visit the Site or use PSA services, we may use Personal Information that we receive about you to send you information about new features, opportunities or products. If you have agreed to receive marketing information, you may always opt out by either using the unsubscribe link in a marketing communication or by contacting us directly using the information at the end of this Privacy Policy.

4. Legal Disclosure Requirement
We may disclose Personal Information to third parties when we believe disclosure is required or appropriate (1) to comply with applicable laws, regulations, subpoenas, court orders, and the like; (2) to enforce or give effect to written agreements that we are party to; or (3) to protect the rights, property, or safety of us, our employees, other Site  or services users, or the public.

5. Improvement
We may retain the metadata and content of any communication you have with us, regardless of the subject matter or the mode of communication. This information helps us to improve our products and services, as well as the Site and PSA services, the content, materials, opportunities, and services that we feature or describe on the Site, and to more effectively and efficiently respond to both current and future inquiries.

6. International Users
If you are using either the Site outside the United States, you expressly acknowledge and agree that your Personal Information and other information may be processed in the United States and other countries. Privacy laws may be less stringent or different in the United States or other countries than in your country of residence. D. EXCLUSIONS

1. Links to Third-Party Websites or Applications
This Privacy Policy applies only to the Site and PSA services. Use of the Site may involve links to other websites or applications provided by companies other than PSA (“Third-Party Providers”). This Privacy Policy does not apply to such sites or applications offered or provided by Third-Party Providers and PSA does not endorse or review sites or applications provided by Third-Party Providers. You may wish to contact those Third-Party Providers directly for information on their privacy practices.

2. Information Not Collected by Site and Unsolicited Information
This Privacy Policy does not apply to Personal Information collected by PSA other than Personal Information collected through use of the Site. This Privacy Policy does not apply to any information you provide that we did not request, whether through use of the Site or provided in some other way. This includes but is not limited to information posted to public areas of the Site and ideas for new products, enhancements to existing products and other unsolicited information (collectively, “Unsolicited Information”). All Unsolicited Information is deemed to be owned by us and non-confidential and we are free to reproduce, use, disclose and distribute Unsolicited Information without limitation or attributed.

3. Children’s Personal Information
Neither the Site nor PSA services are directed at persons under the age of 13. We do not knowingly collect Personal Information from children under 13 years of age nor do we have any reasonable grounds for believing that children under the age of 13 are accessing our Site or the PSA services. If we do learn that we have inadvertently collected Personal Information from a child under the age of 13, we will promptly delete that information. If you believe that we may have collected any Personal Information from a child under 13 years of age, please contact us directly using the information at the end of this Privacy Policy.

E. SECURITY AND STORAGE 

1. Our Measures
We take technical and organizational measures designed to protect your Personal Information, to protect Personal Information from loss, misuse and unauthorized access, disclosure, alteration or destruction. However, neither the internet nor any technology is guaranteed to be fully secure or without error and PSA cannot and does not guarantee that Personal Information provided to us will not be lost, misused, accessed, disclosed, altered or destroyed.

2. Your Responsibilities
You are responsible for the appropriate use and safeguarding of any login information regarding the use of the PSA services. It is important for you to protect against unauthorized access to your login ID and password, to your Personal Information, and to your computer.

3. Retention and Deletion of Personal Information
We delete Personal Information once we determine that the purpose for which it was collected, or a compatible purpose, is complete, unless a longer period is required (i) by law or to comply with legal obligations; (ii) to resolve disputes; or (iii) to protect our legal rights.

F. YOUR CHOICES AND RIGHTS

1. Potential Specific Data Privacy Rights
Some rights such as the right to access, delete, correct, and object to processing of Personal Information and similar rights may apply to you and some may not but, for clarity, this section is intended to give you notice that you may have certain legal rights regarding Personal Information collected or used by us. If you would like to exercise any of these rights, (1) contact us using the Contact Information at the bottom of this Privacy Policy; (2) provide enough information to identify you (e.g., your full name and email address associated with the Site); and (3) state what right you want to exercise and the information to which your request relates. Depending on the nature of your request, we may require proof of your identity.

2. Opt-Out Procedures
If you would like to withdraw your consent for us to use your Personal Information, you may do so by contacting us using the Contact Information at the end of this Privacy Notice. You may also unsubscribe from marketing communications using the link in the communication. However, if you withdraw your consent, this may impact the ability for us to provide our services and PSA services may be unavailable for use.
